Competition Terms & Conditions

1. Promoter

1.1The promoter is Mynott Construction Pty Ltd (ABN 61 633 361 725) trading as 2nd Dawn, Perth, Western Australia ("the Promoter").

1.2The Promoter is a registered Western Australian builder, builder registration number BC 103087. The director of the Promoter is David Mynott.

1.3The Promoter's marketing agency for this competition is Jordan James Media ("the Agency").

1.4By submitting an entry, each entrant accepts these Terms and Conditions ("Terms") in full.

2. The competition and how to enter

2.1The competition is the "2nd Dawn Half-Price Build" competition ("the Competition"). It is a judged competition — a game of skill. Chance plays no part in determining the winner (see clause 5).

2.2Entry is free. No purchase, payment or other consideration is required to enter.

2.3To enter, an eligible person must complete and submit the entry form at https://2nddawn.com.au/giveaway ("the Competition Website"), including a written statement of between 100 and 500 words answering the question: "Why do you want to build a sustainable home, and why now?" ("the Entry").

2.4Entries may be submitted from the time the Competition is published at the Competition Website and close at 11:59pm AWST on Wednesday 30 September 2026 ("the Closing Time"). Entries received after the Closing Time will not be accepted.

2.5One entry per person. If a person submits more than one entry, only the first valid entry received will be judged.

2.6The Entry must be the entrant's own original work, written by the entrant. Entries that are incomplete, that do not answer the entry question, or that fall outside the 100–500 word range are invalid.

2.7Entry is only via the form at the Competition Website. Entrants are not required to share, repost, tag anyone, or take any action on any social media platform to enter or to improve their chances.

3. Eligibility

3.1Entry is open only to individuals who, at the time of entry, meet all of the following: (a)are aged 18 years or over; (b)are residents of Western Australia; (c)own residential land in the Perth metropolitan area, or are the purchaser of residential land in the Perth metropolitan area under a contract with unconditional settlement in progress; (d)are able to finance the winner's payable amount of approximately $300,000 plus the excluded costs described in clause 4.5; and (e)accept that the design, materials and labour for the prize home are 2nd Dawn's (see clause 8).

3.2The Competition is restricted to the Perth metropolitan area: the land on which the prize home would be built must be in the Perth metropolitan area.

3.3The following persons are excluded from entering: employees and directors of the Promoter, employees of the Promoter's agencies (including the Agency), and the immediate families of any of them.

3.4The Promoter may require an entrant or the winner to provide evidence of eligibility, including proof of age, residency, land ownership or settlement status, and capacity to fund the winner's payable amount and excluded costs, before confirming any prize.

4. The prize

4.1There is one prize and one winner. The prize is this: 2nd Dawn will design and build a custom-designed single-storey home of 150m², designed to achieve a 7+ star NatHERS energy rating and built with sustainable materials, on the winner's own land in the Perth metropolitan area, at roughly half 2nd Dawn's comparable build value ("the Prize").

4.3The winner's payable amount will be fixed under a written fixed-price building contract that complies with the Home Building Contracts Act 1991 (WA), entered into between the winner and the Promoter before construction commences. The final price is fixed at contract, once the design is settled with the winner. Until then, the figure of approximately $300,000 is an estimate.

4.4The Prize does not include land. The home is built on land the winner already owns (or is settling on) under clause 3.1(c).

4.5Exclusions. The following are excluded from the Prize and are payable by the winner in addition to the winner's payable amount: (a)earthworks and siteworks; (b)service connections; and (c)landscaping.

4.6The Prize is not transferable, cannot be exchanged, and there is no cash alternative. The Prize cannot be applied to any other build, product or service.

5. Judging

5.1The Competition is a game of skill. The winner is determined solely by judging against the published criteria in clause 5.3. Chance plays no part at any stage, including any tiebreak.

5.2Entries are judged by David Mynott, director of 2nd Dawn ("the Judge").

5.3Each valid entry is scored against the following published criteria and weightings: (a)fit with sustainable design and the home 2nd Dawn builds — 30%; (b)genuine need and readiness to build now — 30%; (c)quality and authenticity of the written entry — 25%; (d)feasibility of the entrant's block for a single-storey build — 15%.

5.4The entry with the highest score against the criteria wins. If two or more entries are tied on score, the Judge will re-assess the tied entries against the same published criteria and determine which entry best satisfies them. No random selection is used at any stage.

5.5The Promoter will keep judging records for the Competition.

5.6The Judge's scoring against the published criteria decides the winner. The Judge's decision is final and no correspondence will be entered into.

6. Winner notification and announcement

6.1The winner will be determined and announced by Friday 9 October 2026.

6.2The winner will be notified by phone and email, using the contact details provided in their entry.

6.3The winner may be announced publicly (including on the Competition Website and the Promoter's social channels), and the winner's name and entry may be used in publicity for the Competition, only with the winner's consent.

6.4If the Promoter cannot contact the winner after making reasonable attempts using the details provided in the entry, the forfeit provisions in clause 7 apply.

7. Winner may decline; forfeit

7.1The winner is under no obligation to accept the Prize and may decline it.

7.2The Prize is forfeited if the winner declines the Prize, cannot be contacted under clause 6.4, or is found not to meet the eligibility requirements in clause 3.

7.3If the Prize is forfeited, the Promoter may offer the Prize to the next-highest-scoring valid entry, assessed on the same published criteria in clause 5.3. The provisions of these Terms then apply to that entrant as the winner.

8. Conditions on the build

8.1The winner's land must be titled residential land in the Perth metropolitan area that is buildable — suitable for the construction of a single-storey home.

8.2The home will be custom-designed by 2nd Dawn in consultation with the winner. The winner accepts that the design, materials and labour are 2nd Dawn's, and final decisions on design, materials and labour rest with 2nd Dawn.

8.3Before construction commences, the winner and the Promoter must enter into a written fixed-price building contract that complies with the Home Building Contracts Act 1991 (WA). The final price payable by the winner is fixed at contract, once the design is settled.

8.4Construction can commence from November 2026, subject to design finalisation, execution of the building contract, and building approvals. No completion date is promised or implied by these Terms or any Competition advertising.

9. Privacy collection statement

9.1To enter, the entry form collects: full name, email address, phone number, the street address of the entrant's block, land status (own now / settling), confirmation that the entrant can fund approximately $300,000 plus the excluded costs in clause 4.5, and the written statement. The block address is used to assess eligibility and the block-feasibility judging criterion.

9.2This information is collected to run the Competition: to verify eligibility, judge entries, contact entrants, notify and announce the winner, and keep the records described in these Terms.

9.3Entrant data is held by the Promoter and its marketing agency, Jordan James Media. It is never sold.

9.4Agreement to these Terms and this privacy collection statement is required to enter, via a single consent checkbox on the entry form.

9.5The entry form includes one optional checkbox: "Keep me posted about 2nd Dawn builds and offers." Entrants who tick it may receive updates from 2nd Dawn and can opt out at any time. Leaving it unticked has no effect on an entry or its judging.

9.6Entrants may request access to, or correction of, their information by contacting the Promoter via the contact details published at the Competition Website.

10. Release of Meta Platforms

10.1This Competition is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, or Meta Platforms, Inc. ("Meta").

10.2Entrants provide their information to the Promoter, not to Meta.

10.3Each entrant completely releases Meta from any and all liability in connection with the Competition.

10.4Entry is via the Competition Website only. No sharing, reposting, tagging or other social media action is required or rewarded.

11. General

11.1The Promoter may verify the eligibility of any entrant or the winner at any time, including by requiring the documents described in clause 3.4.

11.2False, misleading or incomplete declarations in an entry make the entry void. If this is discovered after the winner is determined, the Prize is forfeited and clause 7.3 applies.

11.3Entries that do not comply with these Terms are invalid and will not be judged.

11.4The Promoter is not responsible for entries that are lost, delayed or misdirected due to technical failures outside its reasonable control.

11.5Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy an entrant has under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

11.6If any provision of these Terms is found to be invalid or unenforceable, it will be severed and the remaining provisions continue in force.

11.7These Terms are governed by the laws of Western Australia, and the parties submit to the jurisdiction of the courts of Western Australia.
